This Acceptable Use Policy is used in conjunction with the terms of your service agreement. Violating any of these policies grants Lunar Media the authority to take action to terminate your access to Lunar Media Services. We reserve the right, at our discretion, to update or revise this policy and any product offerings or programs described on any Lunar Media web site. A customer's use of Lunar Media Services after changes to the AUP are posted on Lunar Media's web site, www.lunarmedia.net, www.lunargraphics.net www.flashdesign.net or any other domain directed to this site, will constitute the customer's acceptance of any new or additional terms of the AUP that result from those changes. Please check back periodically to review any changes to this policy.

LAWFUL STORAGE
You must use this site and the Lunar Media Services in accordance with the terms of this policy and your Lunar Media Service Agreement, and in accordance with all federal, state and local laws, ordinances, and regulations. Please direct any questions about this agreement to info@lunarmedia.net.

UNLAWFUL USE

Use of this site and/or the Lunar Media Services for any purpose that is unlawful or in any manner which could damage, disable, overburden or impair the operation of this site, is strictly prohibited.
Specifically, you may not:

Attempt to use or gain unauthorized access to hosts, accounts, data, systems or networks of this site, or to probe, scan or test the vulnerability of a system or network of this site or any other party;
Interfere with service to any user, host or network including, without limitation, mail-bombing, flooding, and attempting to deliberately overload the system;
Use this site or Lunar Media Services to engage in activities that violate any terms or conditions of any other network access or Internet service provider.
Distribution of Internet Viruses, Worms, Trojan Horses, or Other Destructive Activities sent via email or any other distribution of destructive activies.

Additionally, you may not upload, post or otherwise distribute or facilitate distribution of any content, including text, communications, software, images, sounds, data, or other information that:

INTELLECTUAL PROPERTY VIOLATIONS

You agree and acknowlege copyrights, trademarks, service marks, patents, trade secrets, and other proprietary rights and laws protect all content and materials available on this site. Engaging in any activity that infringes or misappropriates the intellectual property rights of others will result in Lunar Media's policy to terminate the privileges of customers who commit repeat violations of copyright laws. Lunar Media is required by law to block or remove access to customer content upon receipt of an official notice of a copyright infringement.

The Lunar Media name, Lunar Media design logo, other related names, design marks, product names, feature names and related logos are trademarks of Lunar Media, Inc., and may only be used with the express written permission of Lunar Media. If you use a domain that is related to the Lunar Media Web Site, you must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.

OFFENSIVE SPEECH OR MATERIALS
Using Lunar Media Services to store, transmit, advertise, post, display or otherwise make available illegal materials, including but not limited to, child pornography or obscene materials is strictly prohibited. Lunar Media is required to report to law enforcement agencies when it has become aparent that child pornography is being stored on our network. Lunar Media will seize materials and terminate the customer's account, and report immediately.

DEFAMATORY OR ABUSINVE LANGUAGE
Using the Lunar Media Services as a means to transmit or post defamatory, harassing, abusive, or threatening language.

OTHER ACTIVITIES
Engaging in activities, whether lawful or unlawful, that Lunar Media determines to be harmful to its subscribers, operations, reputation, goodwill, or customer relations.

TERMINATION
Lunar Media Inc. reserves the right, in its sole discretion, to terminate or temporarily suspend your access to Lunar Media Services or any portion thereof at any time, without notice, in the event you violate any terms, conditions or notices contained in this Acceptable Use Policy. In the event of such termination, you will not receive any refund or credit for the amounts paid to Lunar Media. Additionally, termination for violation of this policy may also result in termination charges being assessed against you.
